MCall Margo

Version 1.0 — Draft for review

Operator Agreement

Last updated: June 23, 2026 · This page is maintained by Call Margo to set expectations between us and every business that turns Margo on. It is not legal advice; have your attorney review before signing.

This Operator Agreement (“Agreement”) is between you (the business signing up, the “Operator”) and Call Margo, a registered DBA of Velocity Marketing LLC, a Massachusetts limited liability company (collectively, “Call Margo,” “we,” or “us”). If Call Margo is later spun out into its own LLC, this Agreement automatically assigns to that successor entity with no re-signing required (see §12 Assignment).

1. What Margo is

Margo is a 24/7 AI voice receptionist. She answers inbound calls in a human-sounding voice, follows the script and rules you give her, quotes and books appointments per your rate sheet, sends SMS confirmations, and (on supported tiers) syncs bookings to your dispatch system.

Margo is not a human, a licensed dispatcher, a medical or legal professional, an emergency service, or a substitute for your own staff when a caller needs a real person.

2. What Margo will do

  • Answer every inbound call your forwarding sends her, 24/7.
  • Quote rides, services, or appointments using the rates and rules you configure.
  • Take Stripe deposits or full payment when you enable it.
  • Send the caller an SMS confirmation or follow-up after every handled call.
  • Push confirmed bookings to your dispatch / calendar on supported tiers.
  • Transfer to a human (you or your dispatcher) when the caller asks twice, or on a defined emergency phrase.

3. What Margo will NOT do

  • Guarantee any specific ride, appointment, or service will actually be fulfilled by you or your team.
  • Dispatch a vehicle, ambulance, or emergency response. Margo does not handle 911.
  • Give legal, medical, financial, or regulated advice.
  • Quote prices outside the rate sheet you provide.
  • Substitute for a licensed human dispatcher on safety, security, or compliance calls.

4. Your responsibilities as Operator

  • Keep your rate sheet, fleet, services, and availability current in the dashboard.
  • Review the booking queue at least once per business day.
  • Provide a working human-transfer number that is answered during your stated hours.
  • Hold and maintain your own business licenses, livery / DOT / PUC / TCC permits, chauffeur or trade licenses, and required insurance.
  • Comply with all federal, state, and local laws that apply to your business — including TCPA (texting), CIPA / state recording laws, ADA, and consumer-protection rules.
  • Be the controller of your own customer data; you decide what callers can record, store, and share.

5. Disclaimer of warranties

Margo is provided “AS IS” and “AS AVAILABLE.”We do not warrant that the service will be uninterrupted, error-free, or that every quote, transcript, or booking will be 100% accurate. AI can and does make mistakes. We disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

6. Limitation of liability

To the maximum extent permitted by law, Call Margo’s total cumulative liability to you for any and all claims arising out of or related to the service is capped at the total fees you paid us in the three (3) months immediately preceding the event giving rise to the claim.

We are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages; lost profits or revenue; lost rides or bookings; lost goodwill; or business interruption — even if we were advised of the possibility of such damages.

7. Indemnification (hold harmless)

You agree to defend, indemnify, and hold harmless Call Margo, its founder, employees, contractors, successors, and assigns from any third- party claim, demand, loss, fine, or expense (including reasonable attorneys’ fees) arising out of:

  • Claims by your passengers, customers, patients, or end-users — including but not limited to missed rides, late service, injury, property damage, or service quality.
  • Your violation of any licensing, permitting, insurance, or regulatory requirement applicable to your business.
  • Your violation of TCPA, state recording-consent laws, A2P 10DLC carrier rules, or any other communications law.
  • Content, rate sheets, scripts, or instructions you uploaded that turned out to be wrong, misleading, or unlawful.
  • Disputes between you and a caller about a quote, booking, deposit, or refund.

8. Call recording, SMS, and consent

Calls handled by Margo may be recorded and transcribed so we can deliver the service. You — not Call Margo — are responsible for obtaining any consent required in the jurisdictions where you and your callers are located. We provide a recording-disclosure announcement that can be played on every call in two-party-consent states; you are responsible for keeping it enabled.

Outbound SMS in the United States requires A2P 10DLC registration. You agree to provide accurate registration info, to use SMS only for transactional follow-up with people who called you (no marketing blasts), and to honor STOP / HELP keywords as required by the carriers.

9. Data, retention, and deletion

  • Recordings and transcripts are retained for 90 days on Starter and Growth tiers, and 12 months on Managed, unless you request a different retention period in writing.
  • You can request deletion of any specific call, caller, or your entire dataset at any time by emailing hello@getcallmargo.com.
  • We do not sell caller data. We do not use your callers’ voice recordings to train third-party foundation models.
  • Our subprocessors (Twilio for telephony, ElevenLabs / OpenAI for voice, Stripe for payments, Supabase for storage) are listed in our Privacy Policy.

10. Fees, billing, and minutes

Plans are billed monthly in advance via Stripe. Included minutes reset each billing cycle; overage minutes are billed at the rate shown on the pricing page when used. Fees are non-refundable except where required by law. We may change pricing with 30 days’ notice.

11. Termination

Either side may terminate this Agreement for any reason on 30 days’ written notice. We may suspend or terminate immediately for non-payment, abuse, repeated TCPA / carrier violations, or any unlawful use. On termination you may export your transcripts and recordings for 30 days; after that we may delete them. The Margo phone number returns to the pool.

12. Assignment to a successor entity

Call Margo is currently operated by Velocity Marketing LLC (Massachusetts) under the “Call Margo” DBA. You acknowledge and agree that this Agreement may be automatically assigned and novated to a successor entity (for example, “Call Margo LLC” if the brand is later organized as its own LLC), with no further action required from you. All rights, obligations, and limitations of liability transfer with the assignment. We will post a notice on this page when any such assignment takes effect.

13. Governing law and disputes

This Agreement is governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-laws rules. Exclusive venue for any dispute that cannot be resolved informally is the state or federal courts located in Worcester County, Massachusetts. Both parties waive any right to a jury trial and any right to participate in a class or representative action.

14. Electronic signature

By checking the “I agree” box and typing your full legal name during onboarding, you are signing this Agreement electronically under the federal ESIGN Act and the Massachusetts Uniform Electronic Transactions Act. We record the timestamp, the version of the Agreement you accepted, the name you typed, and the IP address of the request.

15. Changes to this Agreement

We may update this Agreement from time to time. Material changes will be announced by email and in the dashboard. Continued use of the service after a material change constitutes acceptance.
