Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Call Margo (the “Service”), operated by Call Margo (“we,” “us”). By signing up or using the Service, you agree to these Terms.

1. The Service

Call Margo provides an AI voice receptionist that answers phone calls, books appointments, and sends follow-up SMS on behalf of your business. Service availability, features, and minute pools are described on our pricing page.

2. Your account

You must provide accurate information, keep your credentials secure, and be at least 18 years old. You are responsible for all activity on your account.

3. Customer content & license

You retain ownership of the business information, FAQs, recordings, transcripts, and other content associated with your account (“Customer Content”). You grant us a limited license to host, process, and transmit Customer Content solely to provide and improve the Service for you.

4. Acceptable use

  • No unlawful, harassing, deceptive, or abusive use of the Service.
  • No use for marketing, promotional, or political SMS or robocalls. Outbound SMS is strictly transactional follow-up to inbound callers.
  • No use that violates the Telephone Consumer Protection Act (TCPA), CAN-SPAM, A2P 10DLC rules, or any applicable telecom or consumer protection law.
  • No attempt to reverse engineer, resell, or white-label the Service without a written agreement.

5. Call recording & consent

You authorize us to record and transcribe calls made to or from numbers associated with your account. You are responsible for any additional notices or consents required by the jurisdictions in which your business and callers are located. Margo provides a recording-disclosure announcement at the start of calls in two-party-consent states.

6. SMS & A2P 10DLC

To send outbound SMS in the United States, your business must be registered to an A2P 10DLC campaign through our telecom provider. You agree to provide accurate registration information and to comply with carrier requirements. All SMS sent through the Service must include opt-out language on the first message in any thread and must honor STOP, UNSUBSCRIBE, and HELP keywords.

7. Fees, billing & trial

Plans are billed monthly in advance. Your card is not charged until you complete a live test call to Margo and confirm. Minute overages are billed at the rate shown on the pricing page. Fees are non-refundable except where required by law. We may change pricing with 30 days' notice.

8. Third-party services

The Service relies on third-party providers including Twilio and ElevenLabs. We are not responsible for outages or changes in those providers, but we will use commercially reasonable efforts to maintain availability.

9. Cancellation

You may cancel at any time from the dashboard. Cancellation takes effect at the end of the current billing period. Upon cancellation, you may export your data for 30 days, after which it may be deleted.

10. Disclaimers

The Service is provided “as is” and “as available.” Margo is an AI assistant; she may make mistakes, mishear callers, or be unavailable due to upstream outages. We disclaim all warranties to the maximum extent permitted by law, including merchantability, fitness for a particular purpose, and non-infringement. You are responsible for reviewing transcripts, bookings, and messages.

11. Limitation of liability

To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service will not exceed the fees you paid in the three (3) months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages, or lost profits or revenue.

12. Indemnification

You will indemnify and hold us harmless from claims arising out of your Customer Content, your use of the Service, or your violation of these Terms or applicable law (including TCPA and recording-consent laws).

13. Termination

We may suspend or terminate your access for violations of these Terms, non-payment, or to comply with law. Sections that by their nature should survive will survive termination.

14. Governing law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles. Venue lies in the state or federal courts located in Middlesex County, Massachusetts.

15. Changes

We may update these Terms. Material changes will be communicated by email or in the dashboard. Continued use after changes constitutes acceptance.
